Terms of Use

1. Agreement, eligibility and your account

By creating an account or using Mp3 Wars (the "App"), you agree to these Terms and to our Privacy Policy. MP3 WARS LLC ("we", "us") operates the App. If you do not agree, do not use it.

• Age: you must be at least 13 years old. If you are under 18, you confirm a parent or guardian has agreed to these Terms for you.
• Your account: give accurate information, keep your password secret, and tell us if you think your account has been used without permission. You are responsible for what happens under your account.
• One person, one account: do not create accounts to cheat votes or avoid a ban.
• Usernames: we may remove or change a username that is offensive, misleading or impersonates someone.

2. Your content and the license you give us

You keep ownership of the songs, beats, videos, images, posts and comments you upload ("Your Content"). We do not claim your music.

To run the App, you give MP3 WARS LLC a non-exclusive, worldwide, royalty-free license to host, store, stream, display, reproduce and distribute Your Content inside the App and in features such as battles, challenges, leaderboards, shares and promotion of the App. You can end this license for a piece of content by deleting it, except where it has already been shared by others or we must keep a copy by law.

You promise that:

• you own Your Content or have every license and permission needed to upload it, including for any sample, beat, lyric, artwork or video in it
• Your Content does not infringe anyone's copyright, trademark, privacy or other rights
• Your Content follows the rules in section 3

Links to YouTube or SoundCloud stay on those services. You must follow their terms, and we do not host or own that content. Mp3 Wars is not affiliated with or endorsed by YouTube, SoundCloud, Apple or Google.

3. Rules of conduct

You may not use the App to post, send or do any of the following:

• content that infringes copyright, trademarks or other rights, including music you do not have the right to share
• illegal content, or content that promotes violence, terrorism or self-harm
• hate speech, harassment, threats, bullying or stalking
• sexual content involving minors, or sexually explicit content
• spam, scams, phishing or impersonation of another person or brand
• someone's private information without their consent
• votes, plays, follows or other activity that is bought, automated, faked or coordinated to cheat
• viruses, scraping, reverse engineering, or attempts to break or overload the App or its security
• anything that breaks the law or the rules of Apple, Google, YouTube or SoundCloud

Use the Report button on a profile, post, comment or track to tell us about content that breaks these rules. You can also block users from their profile in the App. Blocking someone hides their content from you and stops them from messaging you.

4. Copyright takedowns

We respect copyright and respond to notices of alleged infringement under the U.S. Digital Millennium Copyright Act (DMCA).

To report infringement, email us at support@mp3wars.com with the subject "DMCA notice" and include:

• your name and contact details
• a description of the copyrighted work you say was infringed
• where in the App the material is (a link or the track and username)
• a statement that you believe in good faith the use is not authorized
• a statement, under penalty of perjury, that the notice is accurate and you are the owner or authorized to act for the owner
• your physical or electronic signature

We remove or disable access to material that appears to infringe, and we may tell the user who posted it.

If your content was removed by mistake, you can send us a counter-notice with your contact details, the location of the removed material, a statement under penalty of perjury that you believe it was removed by mistake, and your consent to U.S. court jurisdiction. We may restore the material after the legal waiting period unless the complainant files a court action.

Repeat infringers. We will suspend or end the accounts of users who repeatedly infringe copyright. Knowingly sending a false notice can make you liable for damages.

5. Battles, challenges, leaderboards and the Live room

• Votes decide results. Battle, challenge and leaderboard results come from user votes. A challenge result counts only when it meets the minimum number of votes shown in the App.
• Fair play. We may remove votes, plays, crowns or results that we believe came from cheating, bots or coordinated manipulation, and we may change a result when we do.
• Crowns and rankings are for fun and recognition. They have no cash value and we may reset, change or remove them.
• Feedback. Feedback you leave must follow the rules in section 3. Artists see the feedback about their tracks.
• Live room. Chat, reactions and queue spots in the Live room are public to the room. We may remove messages and people from it at any time.
• No guarantee. We do not promise that any feature will be available, uninterrupted or error-free, and we may change or end features.
• Paid features. If we offer paid promotion or other paid features, we will show the price and terms before you buy. Purchases made through Apple or Google follow their payment terms and refund rules.

6. Moderation, ending your account, and legal terms

Reports and moderation. Our moderators review reports. We aim to act on serious reports quickly, usually within a day, but we cannot promise a response time. We may remove content or accounts at our discretion, and we do not have to tell the person who made a report what we decided.

Moderation and termination. We may remove content, limit features, suspend or ban an account at any time if we believe it breaks these Terms or the law, or puts others at risk. You may stop using the App and delete your account at any time in Settings. Sections that by their nature should survive (such as content licenses already granted, disclaimers, liability limits and governing law) stay in effect.

Disclaimers. The App is provided "as is" and "as available". To the fullest extent the law allows, we disclaim all warranties, including merchantability, fitness for a particular purpose and non-infringement. We do not guarantee that content posted by users is accurate, legal or safe, and we are not responsible for it.

Limit of liability. To the fullest extent the law allows, MP3 WARS LLC and its owners are not liable for indirect, incidental, special or consequential damages, or for lost profits, data or goodwill. Our total liability for any claim relating to the App is limited to the greater of $100 or the amount you paid us in the 12 months before the claim. Some places do not allow these limits, so they may not apply to you.

Your responsibility. You agree to cover claims, losses and costs (including reasonable legal fees) that come from Your Content or your breach of these Terms, to the extent the law allows.

Governing law. Virginia law governs these Terms, without regard to conflict-of-law rules. Disputes will be brought in the state or federal courts located in Virginia, and you agree to their jurisdiction.

Changes. We may update these Terms. We will post the new version with its date, and for material changes we will tell you in the App. Continuing to use the App after a change means you accept it.
